黑龙江省方正县人民政府关于建立完善守信联合激励和失信联合惩戒制度加快推进信用方正建设的实施意见

  为(wei)贯彻落实(shi)《国(guo)务院关于深入推进实(shi)施新一轮东北(bei)振兴战略加(jia)快推动东北(bei)地(di)区经(jing)济企稳向好(hao)若干(gan)重要举(ju)措的意见》(国发〔2016〕62号)、《国务院关于建立完善守信联合激励和失信联合惩戒制度加快推进社会诚信建设的指导意见》(国发〔2016〕33号)、《黑龙江省人民政府关于建立完善守信联合激励和失信联合惩戒制度加快推进社会诚信建设的实施意见》(黑政规〔2017〕5号)和《哈尔滨市人民政府关于建立完善守信联合激励和失信联合惩戒制度推动信用东北建设实施意见》(哈政规〔2017〕24号)精神,积极构建以信用为核心的行政管理、市场监管和社会治理体系,加快推进“信用方正”建设,现结合我县实际,提出如下意见。

  一、总(zong)体要求(qiu)

(一)指导思想(xiang)

  全面贯(guan)彻党(dang)的十九大和(he)习近平总书记系列重(zhong)要讲话精(jing)神,按照国家省(sheng)和(he)市的决策部(bu)署(shu),紧紧围绕“四个全面”战略布局和“五大”发展理念,落实加强和创新社会治理要求,加快推进全县社会信用体系建设。加强信用信息归集共享、公开应用,依法依规运用信用激励和约束手段,构建政府、社会共同参与的跨地区、跨部门、跨领域的守信联合激励和失信联合惩戒机制,促进市场主体依法诚信经营,维护市场正常秩序,营造良好信用环境。

(二)基(ji)本原(yuan)则

1.坚持信用(yong)(yong)公开。在(zai)做好信用(yong)(yong)信息记录归集工作的(de)基础上,逐步将(jiang)社会(hui)(hui)法人、自然(ran)人和社会(hui)(hui)组织等各类社会(hui)(hui)信用(yong)(yong)主体的(de)信用(yong)(yong)信息统(tong)一(yi)归集并公开。

2.坚持奖惩分明。充分运用信(xin)用激励(li)和约束手(shou)段,建立健全守信(xin)者受益、失信(xin)者受限的奖惩机制。

3.坚持(chi)突出重(zhong)(zhong)点。着力解决涉及公共利(li)益和(he)安全(quan)、人民群众反映强烈、对社会发展负面影(ying)响较大(da)的(de)重(zhong)(zhong)点领(ling)域(yu)失(shi)信问(wen)题。

4.坚持协同联动。构建(jian)政(zheng)府部门协同联动、行业组织(zhi)自(zi)律管理、信(xin)用服(fu)务机构积极参与(yu)、社会舆(yu)论(lun)广泛监(jian)督的共同治理格局。

(三)工作目(mu)标

  进一步加(jia)大(da)失信违约(yue)惩戒(jie)力(li)度,突出抓好政府违约(yue)专项整治,大(da)力(li)倡导(dao)做诚信之(zhi)人、办诚信之(zhi)企、建诚信政府。到2018年4月底,基本建立经济社会主要领域守信联合激励和失信联合惩戒机制。到2020年,初步形成政府部门协同联动、行业组织自律管理、信用服务机构积极参与、社会舆论广泛参与的共同治理工作格局,基本建立跨地区、跨部门、跨领域的守信联合激励和失信联合惩戒工作机制,以信用为核心的新型市场监管机制作用得到有效发挥,全社会信用意识普遍增强,“信用方正”建设取得积极效果。

  二、重(zhong)点工作任(ren)务

(一(yi))建(jian)立完善守信联合激励(li)机制

1.多渠道(dao)选树(shu)(shu)诚(cheng)信(xin)(xin)典型。2018年(nian)4月底前,各(ge)部门(men)和(he)社会(hui)组织(zhi)建(jian)立并完(wan)善(shan)社会(hui)法(fa)人、自然人和(he)社会(hui)组织(zhi)信(xin)(xin)用(yong)评价机(ji)制(zhi),及时(shi)、全面、准确记录(lu)信(xin)(xin)用(yong)主(zhu)体的(de)(de)信(xin)(xin)用(yong)信(xin)(xin)息;建(jian)立常(chang)态化报送工作(zuo)机(ji)制(zhi),依(yi)托(tuo)市(shi)信(xin)(xin)用(yong)信(xin)(xin)息共(gong)(gong)享平台共(gong)(gong)享信(xin)(xin)息,联合(he)相关部门(men)和(he)社会(hui)组织(zhi)实(shi)施守信(xin)(xin)激励。开展诚(cheng)信(xin)(xin)创(chuang)建(jian)活(huo)动,依(yi)法(fa)依(yi)规(gui)将(jiang)信(xin)(xin)用(yong)状(zhuang)况良(liang)好的(de)(de)行(xing)政(zheng)相对人、“诚(cheng)信(xin)(xin)示范单位”、“守合(he)同重信(xin)(xin)用(yong)”企业、“诚(cheng)信(xin)(xin)经营(ying)示范点”、诚(cheng)信(xin)(xin)道(dao)德模(mo)范、优(you)秀青年(nian)志(zhi)愿者(zhe)、行(xing)业协会(hui)商会(hui)推荐(jian)的(de)(de)诚(cheng)信(xin)(xin)会(hui)员、新闻媒体挖掘的(de)(de)诚(cheng)信(xin)(xin)主(zhu)体等树(shu)(shu)立为(wei)诚(cheng)实(shi)守信(xin)(xin)典型。(县市(shi)场监管局、县文明办(ban)、县民政(zheng)局分别(bie)牵头,各(ge)部门(men)按职责分工负责)

2.完善(shan)行(xing)(xing)政(zheng)(zheng)(zheng)审批(pi)(pi)绿色(se)通(tong)(tong)道。2018年(nian)3月底前,各部门行(xing)(xing)政(zheng)(zheng)(zheng)审批(pi)(pi)机构依据(ju)权力(li)清(qing)单(dan)和(he)责(ze)任清(qing)单(dan),针对诚信典型和(he)连续3年(nian)无不良(liang)信用记录的(de)行(xing)(xing)政(zheng)(zheng)(zheng)相对人,制定实施(shi)“绿色(se)通(tong)(tong)道”、“容(rong)缺受(shou)理”等行(xing)(xing)政(zheng)(zheng)(zheng)审批(pi)(pi)便(bian)利服务措(cuo)施(shi)。对符(fu)合开(kai)辟绿色(se)通(tong)(tong)道的(de)行(xing)(xing)政(zheng)(zheng)(zheng)相对人,通(tong)(tong)过召开(kai)协调(diao)会、提前介入等方式先(xian)行(xing)(xing)受(shou)理,加快办(ban)理速度。(县行(xing)(xing)政(zheng)(zheng)(zheng)审批(pi)(pi)服务中心(xin)牵(qian)头,各部门按职责(ze)分工负责(ze))

3.优(you)(you)先提(ti)供(gong)便(bian)利化公共服务(wu)。通过查询省、市(shi)信(xin)用(yong)信(xin)息共享平台信(xin)用(yong)信(xin)息或使(shi)用(yong)第三方信(xin)用(yong)服务(wu)机构提(ti)供(gong)的信(xin)用(yong)报告等方式,在实(shi)施(shi)财政(zheng)(zheng)性资金项目(mu)安排、招商引资配套优(you)(you)惠政(zheng)(zheng)策(ce)(ce)等各类(lei)政(zheng)(zheng)府优(you)(you)惠政(zheng)(zheng)策(ce)(ce)中,优(you)(you)先考虑守(shou)信(xin)市(shi)场主体。对守(shou)信(xin)主体给予重(zhong)点(dian)支(zhi)持和优(you)(you)先便(bian)利。(县(xian)发改局、县(xian)财政(zheng)(zheng)局、县(xian)国(guo)税局、县(xian)地税局、县(xian)市(shi)场监管局分(fen)别牵头,各部门按(an)职责(ze)分(fen)工(gong)负(fu)责(ze))

4.创新守(shou)信企(qi)业(ye)行政监(jian)管(guan)。县市(shi)场监(jian)管(guan)部(bu)门(men)在企(qi)业(ye)监(jian)管(guan)、食品(pin)药品(pin)安全(quan)、消费安全(quan)、安全(quan)生产等领域,根(gen)据监(jian)管(guan)对象的(de)信用(yong)记录(lu)和(he)信用(yong)评价分类(lei),运用(yong)信息化手段,创新市(shi)场经营交易行为监(jian)管(guan)方式,为市(shi)场主体提供便利服务(wu)(wu)。依据国家和(he)省、市(shi)明(ming)确的(de)守(shou)信激(ji)励手段,制定(ding)本(ben)部(bu)门(men)事中、事后监(jian)管(guan)实施(shi)方案,对符(fu)合一定(ding)条件(jian)的(de)守(shou)信企(qi)业(ye),优(you)化日常检查和(he)专项检查频次。(县市(shi)场监(jian)管(guan)局(ju)(ju)、县安监(jian)局(ju)(ju)、县商务(wu)(wu)粮食局(ju)(ju)分别牵头,各部(bu)门(men)按职责(ze)分工负责(ze))

5.提(ti)供(gong)市(shi)场优(you)惠(hui)服务(wu)(wu)。鼓(gu)励有关部(bu)(bu)门和(he)金融机构(gou)、商业销售机构(gou)等(deng)(deng)市(shi)场服务(wu)(wu)机构(gou)大(da)力开(kai)发“信(xin)(xin)易贷(dai)”、“信(xin)(xin)易债(zhai)”、“税易贷(dai)”等(deng)(deng)守(shou)信(xin)(xin)激励产品(pin),规(gui)范提(ti)供(gong)市(shi)场主体信(xin)(xin)用信(xin)(xin)息、信(xin)(xin)用积分(fen)和(he)信(xin)(xin)用评价结果(guo),对守(shou)信(xin)(xin)市(shi)场主体给予优(you)惠(hui)和(he)便利,使守(shou)信(xin)(xin)者(zhe)获(huo)得更多机会和(he)实惠(hui)。(县人民银行、县银监(jian)局、县国税局、县地税局分(fen)别牵(qian)头,各(ge)部(bu)(bu)门按职责分(fen)工负责)

6.多渠道推(tui)介守(shou)信(xin)(xin)市场(chang)(chang)主(zhu)(zhu)体。各部门应及(ji)时将守(shou)信(xin)(xin)市场(chang)(chang)主(zhu)(zhu)体优良信(xin)(xin)用(yong)(yong)(yong)信(xin)(xin)息报(bao)送(song)至县(xian)(xian)信(xin)(xin)用(yong)(yong)(yong)办(ban),由县(xian)(xian)信(xin)(xin)用(yong)(yong)(yong)办(ban)向上级(ji)主(zhu)(zhu)管部门报(bao)送(song)在“信(xin)(xin)用(yong)(yong)(yong)哈尔滨(bin)”网站进行(xing)(xing)公示(shi),并在会(hui)(hui)展、银企(qi)(qi)对接等活动(dong)中(zhong)重(zhong)(zhong)点推(tui)介守(shou)信(xin)(xin)企(qi)(qi)业(ye)(ye),让诚信(xin)(xin)成为市场(chang)(chang)配置资(zi)源的(de)重(zhong)(zhong)要(yao)考量(liang)因素。大(da)(da)力宣传守(shou)信(xin)(xin)企(qi)(qi)业(ye)(ye)、群体和个人,积极评选诚实守(shou)信(xin)(xin)道德模范。支持(chi)征信(xin)(xin)机(ji)构加(jia)强对市场(chang)(chang)主(zhu)(zhu)体正面(mian)信(xin)(xin)息的(de)采(cai)集,在失信(xin)(xin)问(wen)题反映较为集中(zhong)的(de)行(xing)(xing)业(ye)(ye)领域,加(jia)大(da)(da)对守(shou)信(xin)(xin)者的(de)激励性评分(fen)比重(zhong)(zhong)。推(tui)动(dong)行(xing)(xing)业(ye)(ye)协(xie)会(hui)(hui)商(shang)会(hui)(hui)加(jia)强信(xin)(xin)用(yong)(yong)(yong)建(jian)设(she)和行(xing)(xing)业(ye)(ye)自律,表彰守(shou)信(xin)(xin)会(hui)(hui)员。引(yin)导企(qi)(qi)业(ye)(ye)主(zhu)(zhu)动(dong)发布(bu)综合信(xin)(xin)用(yong)(yong)(yong)承诺(nuo)或产(chan)品服务质量(liang)等专项承诺(nuo),开展产(chan)品服务标准等自我声明公开,主(zhu)(zhu)动(dong)接受社(she)会(hui)(hui)监督。(县(xian)(xian)委(wei)宣传部、县(xian)(xian)文明办(ban)、县(xian)(xian)住建(jian)局(ju)(ju)、县(xian)(xian)国土资(zi)源局(ju)(ju)、县(xian)(xian)市场(chang)(chang)监管局(ju)(ju)、县(xian)(xian)旅游局(ju)(ju)、县(xian)(xian)民政局(ju)(ju)分(fen)别牵头,各部门按职责分(fen)工(gong)负责)

(二(er))健(jian)全(quan)完善失信联合惩戒机制

7.对(dui)重(zhong)(zhong)(zhong)点领(ling)域严(yan)(yan)重(zhong)(zhong)(zhong)失(shi)信(xin)(xin)(xin)行(xing)(xing)(xing)(xing)(xing)(xing)为(wei)(wei)实(shi)施联(lian)合(he)(he)(he)惩(cheng)戒(jie)(jie)。2018年3月底前,各部门(men)和(he)社会(hui)组(zu)织要(yao)制(zhi)定(ding)本领(ling)域失(shi)信(xin)(xin)(xin)行(xing)(xing)(xing)(xing)(xing)(xing)为(wei)(wei)认(ren)定(ding)、等级划分(fen)(fen)(fen)和(he)分(fen)(fen)(fen)类(lei)监管(guan)实(shi)施措(cuo)施,对(dui)失(shi)信(xin)(xin)(xin)行(xing)(xing)(xing)(xing)(xing)(xing)为(wei)(wei)进行(xing)(xing)(xing)(xing)(xing)(xing)处理和(he)评价,并(bing)通过市信(xin)(xin)(xin)用信(xin)(xin)(xin)息(xi)(xi)共享平台实(shi)现信(xin)(xin)(xin)息(xi)(xi)共享,推动其他部门(men)和(he)社会(hui)组(zu)织依(yi)法(fa)依(yi)规对(dui)重(zhong)(zhong)(zhong)点领(ling)域严(yan)(yan)重(zhong)(zhong)(zhong)失(shi)信(xin)(xin)(xin)行(xing)(xing)(xing)(xing)(xing)(xing)为(wei)(wei)采取联(lian)合(he)(he)(he)惩(cheng)戒(jie)(jie)措(cuo)施。一是(shi)(shi)严(yan)(yan)重(zhong)(zhong)(zhong)危害人(ren)民群众(zhong)身体健康(kang)和(he)生命(ming)安全的(de)行(xing)(xing)(xing)(xing)(xing)(xing)为(wei)(wei),包(bao)(bao)括食品(pin)(pin)药品(pin)(pin)、生态环(huan)境、工程质(zhi)量、安全生产(chan)(chan)、消防(fang)(fang)安全、强制(zhi)性产(chan)(chan)品(pin)(pin)认(ren)证(zheng)等领(ling)域的(de)严(yan)(yan)重(zhong)(zhong)(zhong)失(shi)信(xin)(xin)(xin)行(xing)(xing)(xing)(xing)(xing)(xing)为(wei)(wei)。二是(shi)(shi)严(yan)(yan)重(zhong)(zhong)(zhong)破坏(huai)市场(chang)秩(zhi)序和(he)社会(hui)正常秩(zhi)序的(de)行(xing)(xing)(xing)(xing)(xing)(xing)为(wei)(wei),包(bao)(bao)括贿赂、逃(tao)(tao)税骗(pian)税、套取骗(pian)取住房公积金、故(gu)意(yi)(yi)(yi)(yi)拖欠或少(shao)缴(jiao)以及(ji)违规使用各类(lei)资(zi)金(基金)、恶意(yi)(yi)(yi)(yi)逃(tao)(tao)废债(zhai)务(wu)、恶意(yi)(yi)(yi)(yi)拖欠货款或服务(wu)费(fei)、恶意(yi)(yi)(yi)(yi)欠薪、非法(fa)集(ji)资(zi)、不正当(dang)竞争、合(he)(he)(he)同欺诈(zha)、传销、无证(zheng)照经营(ying)、制(zhi)售假冒伪(wei)劣产(chan)(chan)品(pin)(pin)和(he)故(gu)意(yi)(yi)(yi)(yi)侵犯知识(shi)产(chan)(chan)权(quan)、出借(jie)和(he)借(jie)用资(zi)质(zhi)投(tou)标(biao)、虚(xu)假投(tou)标(biao)、围标(biao)串标(biao)、虚(xu)假广告、侵害消费(fei)者或证(zheng)券期(qi)货投(tou)资(zi)者合(he)(he)(he)法(fa)权(quan)益、严(yan)(yan)重(zhong)(zhong)(zhong)破坏(huai)网络空间传播秩(zhi)序、聚众(zhong)扰(rao)乱(luan)社会(hui)秩(zhi)序等严(yan)(yan)重(zhong)(zhong)(zhong)失(shi)信(xin)(xin)(xin)行(xing)(xing)(xing)(xing)(xing)(xing)为(wei)(wei)。三(san)是(shi)(shi)拒(ju)不履(lv)(lv)行(xing)(xing)(xing)(xing)(xing)(xing)法(fa)定(ding)义务(wu),严(yan)(yan)重(zhong)(zhong)(zhong)影响(xiang)司法(fa)机关(guan)、行(xing)(xing)(xing)(xing)(xing)(xing)政机关(guan)公信(xin)(xin)(xin)力的(de)行(xing)(xing)(xing)(xing)(xing)(xing)为(wei)(wei),包(bao)(bao)括当(dang)事人(ren)在(zai)司法(fa)机关(guan)、行(xing)(xing)(xing)(xing)(xing)(xing)政机关(guan)作出判决或决定(ding)后(hou),有履(lv)(lv)行(xing)(xing)(xing)(xing)(xing)(xing)能力但拒(ju)不履(lv)(lv)行(xing)(xing)(xing)(xing)(xing)(xing)、逃(tao)(tao)避(bi)(bi)执行(xing)(xing)(xing)(xing)(xing)(xing)等严(yan)(yan)重(zhong)(zhong)(zhong)失(shi)信(xin)(xin)(xin)行(xing)(xing)(xing)(xing)(xing)(xing)为(wei)(wei)。四是(shi)(shi)拒(ju)不履(lv)(lv)行(xing)(xing)(xing)(xing)(xing)(xing)国(guo)防(fang)(fang)义务(wu),拒(ju)绝、逃(tao)(tao)避(bi)(bi)兵役,拒(ju)绝、拖延民用资(zi)源征用或者阻碍对(dui)被征用的(de)民用资(zi)源进行(xing)(xing)(xing)(xing)(xing)(xing)改造,危害国(guo)防(fang)(fang)利益,破坏(huai)国(guo)防(fang)(fang)设施等行(xing)(xing)(xing)(xing)(xing)(xing)为(wei)(wei)。(各部门(men)按职(zhi)责分(fen)(fen)(fen)工负责)

8.对失(shi)(shi)信(xin)行(xing)为实施行(xing)政(zheng)(zheng)(zheng)性(xing)约(yue)束和(he)(he)惩戒。各部(bu)门将严(yan)(yan)重(zhong)失(shi)(shi)信(xin)主体(ti)列为重(zhong)点监管对象,并(bing)(bing)根据监管职权(quan)和(he)(he)国家、省、市有(you)关部(bu)署,于2018年3月底前制(zhi)定(ding)、发(fa)布针(zhen)对严(yan)(yan)重(zhong)失(shi)(shi)信(xin)主体(ti)的(de)行(xing)政(zheng)(zheng)(zheng)性(xing)约(yue)束和(he)(he)惩戒具(ju)体(ti)措施,明(ming)确实施主体(ti)、工(gong)作流程等,依法依规实施惩戒。从(cong)(cong)严(yan)(yan)审(shen)核(he)行(xing)政(zheng)(zheng)(zheng)许可(ke)审(shen)批项目(mu),从(cong)(cong)严(yan)(yan)控制(zhi)生(sheng)产许可(ke)证发(fa)放,限(xian)制(zhi)新增项目(mu)审(shen)批、核(he)准,限(xian)制(zhi)发(fa)起设(she)立或参股金融机构以及小额贷款公司(si)、融资(zi)担保公司(si)、创业(ye)投资(zi)企业(ye)、互联(lian)网(wang)融资(zi)平台(tai)等机构,限(xian)制(zhi)从(cong)(cong)事(shi)互联(lian)网(wang)信(xin)息服(fu)务等。严(yan)(yan)格限(xian)制(zhi)申请财政(zheng)(zheng)(zheng)性(xing)资(zi)金项目(mu),限(xian)制(zhi)参与有(you)关公共资(zi)源(yuan)交易活动,限(xian)制(zhi)参与基础设(she)施和(he)(he)公用事(shi)业(ye)特许经营。对严(yan)(yan)重(zhong)失(shi)(shi)信(xin)企业(ye)及其法定(ding)代(dai)表人(ren)(ren)、主要负责(ze)人(ren)(ren)和(he)(he)对失(shi)(shi)信(xin)行(xing)为负有(you)直(zhi)接(jie)责(ze)任的(de)注册执业(ye)人(ren)(ren)员(yuan)等,实施市场和(he)(he)行(xing)业(ye)禁(jin)入措施。及时撤销严(yan)(yan)重(zhong)失(shi)(shi)信(xin)企业(ye)及其法定(ding)代(dai)表人(ren)(ren)、负责(ze)人(ren)(ren)、高级管理人(ren)(ren)员(yuan)和(he)(he)对失(shi)(shi)信(xin)行(xing)为负有(you)直(zhi)接(jie)责(ze)任的(de)董事(shi)、股东(dong)等人(ren)(ren)员(yuan)的(de)荣(rong)誉称号,并(bing)(bing)取消其参加评先评优资(zi)格。(县(xian)(xian)(xian)(xian)发(fa)改局(ju)、县(xian)(xian)(xian)(xian)财政(zheng)(zheng)(zheng)局(ju)、县(xian)(xian)(xian)(xian)工(gong)信(xin)局(ju)、县(xian)(xian)(xian)(xian)市场监管局(ju)、县(xian)(xian)(xian)(xian)住建局(ju)、县(xian)(xian)(xian)(xian)商(shang)务粮食局(ju)、县(xian)(xian)(xian)(xian)交通运(yun)输局(ju)分(fen)别牵(qian)头,各部(bu)门按职责(ze)分(fen)工(gong)负责(ze))

11.对失(shi)信(xin)行(xing)(xing)为实施(shi)社会性约(yue)束(shu)和惩戒(jie)。充(chong)分发挥公(gong)益(yi)慈善(shan)类(lei)社会组织、民(min)办非(fei)企业单位(wei)等(deng)各类(lei)社会组织作用(yong),引导社会力量广(guang)泛参与失(shi)信(xin)联合惩戒(jie)。支持有(you)关社会组织依(yi)法对污染环境、侵害消费者或公(gong)众投资者合法权益(yi)等(deng)群(qun)体性侵权行(xing)(xing)为提(ti)起公(gong)益(yi)诉讼。鼓励公(gong)正、独立(li)、有(you)条(tiao)件的社会机(ji)构开(kai)展失(shi)信(xin)行(xing)(xing)为大(da)数据舆情监测,编制发布本行(xing)(xing)业信(xin)用(yong)分析报告。(县(xian)(xian)公(gong)安局(ju)、县(xian)(xian)民(min)政局(ju)、县(xian)(xian)环保局(ju)、县(xian)(xian)市场监管(guan)局(ju)分别牵(qian)头(tou),各部门按职责分工(gong)负责)。

12.实施(shi)(shi)个人(ren)(ren)(ren)(ren)失信(xin)(xin)行为(wei)联(lian)(lian)合(he)(he)惩戒(jie)(jie)。各部(bu)门要(yao)逐(zhu)步建立健全个人(ren)(ren)(ren)(ren)信(xin)(xin)用(yong)档案,加强个人(ren)(ren)(ren)(ren)信(xin)(xin)用(yong)信(xin)(xin)息记(ji)录和归集,逐(zhu)步推动失信(xin)(xin)联(lian)(lian)合(he)(he)惩戒(jie)(jie)措施(shi)(shi)落(luo)实到人(ren)(ren)(ren)(ren)。对企(qi)事业单(dan)位严重失信(xin)(xin)行为(wei),在(zai)记(ji)入企(qi)事业单(dan)位信(xin)(xin)用(yong)记(ji)录的(de)同(tong)时,记(ji)入其(qi)法定代表人(ren)(ren)(ren)(ren)、主要(yao)负(fu)责(ze)人(ren)(ren)(ren)(ren)和其(qi)他负(fu)有直接责(ze)任人(ren)(ren)(ren)(ren)员的(de)个人(ren)(ren)(ren)(ren)信(xin)(xin)用(yong)档案。在(zai)对失信(xin)(xin)企(qi)事业单(dan)位进行联(lian)(lian)合(he)(he)惩戒(jie)(jie)的(de)同(tong)时,依法依规对相关责(ze)任人(ren)(ren)(ren)(ren)员采取相应的(de)联(lian)(lian)合(he)(he)惩戒(jie)(jie)措施(shi)(shi)。(各部(bu)门按职责(ze)分工(gong)负(fu)责(ze))

14.完善(shan)信用(yong)“红(hong)黑名(ming)(ming)(ming)单”制(zhi)度(du)。建(jian)立并完善(shan)各(ge)领(ling)域(yu)诚信典型(xing)“红(hong)名(ming)(ming)(ming)单”制(zhi)度(du)和严重(zhong)(zhong)失信主(zhu)体“黑名(ming)(ming)(ming)单”制(zhi)度(du),依(yi)法(fa)依(yi)规规范“红(hong)黑名(ming)(ming)(ming)单”产生(sheng)和发(fa)布行为,建(jian)立健全(quan)退出机(ji)(ji)(ji)制(zhi)。其中,产品质量、环境保(bao)(bao)护(hu)、税(shui)收等重(zhong)(zhong)点领(ling)域(yu)2018年3月底(di)前实施。在保(bao)(bao)证独立、公(gong)正、客观前提(ti)下(xia),鼓励有关(guan)群众团体、金(jin)融机(ji)(ji)(ji)构(gou)、征(zheng)信机(ji)(ji)(ji)构(gou)、评级机(ji)(ji)(ji)构(gou)、行业(ye)协会商会等制(zhi)定(ding)合理的信用(yong)评价(jia)办法(fa),将产生(sheng)的“红(hong)黑名(ming)(ming)(ming)单”信息依(yi)托市(shi)(shi)信用(yong)信息共享平台在“信用(yong)哈尔滨”网站(zhan)发(fa)布,供政府部门(men)和社会参(can)考使用(yong)。(县市(shi)(shi)场监管局(ju)(ju)、县环保(bao)(bao)局(ju)(ju)、县国税(shui)局(ju)(ju)、县地税(shui)局(ju)(ju)分别牵头,各(ge)部门(men)按职责(ze)分工负责(ze))

15.建(jian)立(li)激(ji)励(li)(li)(li)和(he)惩(cheng)戒(jie)措(cuo)(cuo)(cuo)施(shi)(shi)清单(dan)制度。各(ge)(ge)部门(men)要(yao)全面梳理(li)法规和(he)政策明确的(de)联(lian)合(he)(he)激(ji)励(li)(li)(li)和(he)惩(cheng)戒(jie)事项,建(jian)立(li)守信联(lian)合(he)(he)激(ji)励(li)(li)(li)和(he)失信联(lian)合(he)(he)惩(cheng)戒(jie)的(de)强制性、推(tui)荐性两类措(cuo)(cuo)(cuo)施(shi)(shi)清单(dan)。强制性措(cuo)(cuo)(cuo)施(shi)(shi)是指依(yi)法必须(xu)联(lian)合(he)(he)执行的(de)激(ji)励(li)(li)(li)和(he)惩(cheng)戒(jie)措(cuo)(cuo)(cuo)施(shi)(shi);推(tui)荐性措(cuo)(cuo)(cuo)施(shi)(shi)是指符合(he)(he)褒(bao)扬守信、惩(cheng)戒(jie)失信政策导(dao)向,可(ke)根据实际情况实施(shi)(shi)的(de)措(cuo)(cuo)(cuo)施(shi)(shi)。县社会信用体系建(jian)设牵头单(dan)位于(yu)2018年3月底前汇总并(bing)完善(shan)两级激(ji)励(li)(li)(li)和(he)惩(cheng)戒(jie)措(cuo)(cuo)(cuo)施(shi)(shi)清单(dan),实行动(dong)态(tai)更新(xin),作为(wei)实施(shi)(shi)联(lian)动(dong)奖惩(cheng)依(yi)据。(各(ge)(ge)部门(men)按职责分工(gong)负责)

16.建立健全信用修复(fu)机制。各领域(yu)联合(he)惩戒(jie)(jie)措施发起(qi)单位和实施单位应按照法律法规、政策规定(ding)明确(que)(que)各类(lei)失(shi)信行(xing)为(wei)(wei)的联合(he)惩戒(jie)(jie)期限(xian)。对(dui)在(zai)规定(ding)期限(xian)内纠(jiu)(jiu)正失(shi)信行(xing)为(wei)(wei)、消除不良影响的,不再作(zuo)为(wei)(wei)联合(he)惩戒(jie)(jie)对(dui)象。2018年4月底前,各有关(guan)部门要明确(que)(que)本部门、本行(xing)业信用修复(fu)条件和程(cheng)序,建立有利于自我纠(jiu)(jiu)错、主动自新的社会鼓励与关(guan)爱机制。利用教育培(pei)训、强化指导(dao)等(deng)手段,支持有失(shi)信行(xing)为(wei)(wei)的个人(ren)(ren)通(tong)过社会公益服务等(deng)方式(shi)修复(fu)个人(ren)(ren)信用,重塑(su)诚实守信形象。(各部门按职责分(fen)工负责)

17.建立健全信用主(zhu)(zhu)(zhu)体(ti)(ti)权(quan)益保护机制(zhi)。各部(bu)(bu)门在执行失信联合惩戒(jie)措(cuo)(cuo)施时(shi)主(zhu)(zhu)(zhu)动(dong)发现(xian)、经信用主(zhu)(zhu)(zhu)体(ti)(ti)提出异议申请或投诉(su)发现(xian)信息(xi)不实的,应(ying)(ying)及(ji)时(shi)告知信息(xi)提供单位(wei)核实,信息(xi)提供单位(wei)应(ying)(ying)尽快核实并反馈。联合惩戒(jie)措(cuo)(cuo)施在信息(xi)核实期间暂不执行。经核实有(you)误(wu)的信息(xi)应(ying)(ying)及(ji)时(shi)更正或撤(che)销。对因错(cuo)误(wu)采(cai)取联合惩戒(jie)措(cuo)(cuo)施损(sun)害有(you)关主(zhu)(zhu)(zhu)体(ti)(ti)合法权(quan)益的,有(you)关部(bu)(bu)门和单位(wei)应(ying)(ying)积极采(cai)取措(cuo)(cuo)施恢复其信誉,消(xiao)除不良影响。支持有(you)关主(zhu)(zhu)(zhu)体(ti)(ti)通过行政复议、行政诉(su)讼等方式维(wei)护自(zi)身合法权(quan)益。(各部(bu)(bu)门按(an)职责(ze)分工负责(ze))

18.建(jian)立跟踪问效机(ji)制。依托市(shi)信(xin)用(yong)(yong)信(xin)息(xi)共享平台,建(jian)立健全信(xin)用(yong)(yong)联(lian)合奖(jiang)惩(cheng)跟踪、监测、统计及评估机(ji)制,并建(jian)立相应的督查、考核制度。对信(xin)用(yong)(yong)信(xin)息(xi)归集、共享和(he)激励(li)惩(cheng)戒(jie)措施落实不力的部门(men),将(jiang)采取(qu)适当方式进行通报(bao)和(he)督促整改。(县信(xin)用(yong)(yong)办牵头,各部门(men)按职责(ze)分(fen)工负责(ze))

20.加(jia)强(qiang)诚(cheng)(cheng)(cheng)信(xin)(xin)教(jiao)(jiao)育(yu)和(he)(he)(he)(he)(he)文化建(jian)设(she)(she)。践(jian)行(xing)(xing)社会(hui)主(zhu)义核心价值观,秉持现代市场经济的契约(yue)精神(shen),把宣传(chuan)教(jiao)(jiao)育(yu)与(yu)诚(cheng)(cheng)(cheng)信(xin)(xin)文化结合(he)起(qi)来提升公民诚(cheng)(cheng)(cheng)信(xin)(xin)意识和(he)(he)(he)(he)(he)社会(hui)诚(cheng)(cheng)(cheng)信(xin)(xin)水平。开展“百城万(wan)店无假货”、“诚(cheng)(cheng)(cheng)信(xin)(xin)做产品”、3.l5消(xiao)费者权益日和(he)(he)(he)(he)(he)食品安全宣传(chuan)周等(deng)主(zhu)题活(huo)动,引导广(guang)大社会(hui)信(xin)(xin)用(yong)主(zhu)体(ti)树立“诚(cheng)(cheng)(cheng)信(xin)(xin)兴商”理(li)念,多(duo)渠道宣传(chuan)诚(cheng)(cheng)(cheng)信(xin)(xin)企业、群(qun)(qun)体(ti)和(he)(he)(he)(he)(he)个人(ren)(ren)。加(jia)大对守(shou)信(xin)(xin)联合(he)激励和(he)(he)(he)(he)(he)失(shi)(shi)信(xin)(xin)联合(he)惩戒的宣传(chuan)报(bao)道和(he)(he)(he)(he)(he)案(an)例剖析力度(du),利用(yong)报(bao)刊(kan)、广(guang)播(bo)、电视(shi)、网络(luo)等(deng)媒体(ti)依法曝光社会(hui)影响恶劣(lie)、情节严重的失(shi)(shi)信(xin)(xin)案(an)件,开展群(qun)(qun)众(zhong)评议(yi)活(huo)动。披露失(shi)(shi)信(xin)(xin)败(bai)德行(xing)(xing)为(wei),形成对严重失(shi)(shi)信(xin)(xin)行(xing)(xing)为(wei)的舆(yu)论压力和(he)(he)(he)(he)(he)道德约(yue)束。开展对公职人(ren)(ren)员、企业负责人(ren)(ren)、会(hui)计(ji)审计(ji)人(ren)(ren)员、保险经纪(ji)人(ren)(ren)、导游和(he)(he)(he)(he)(he)学生(sheng)等(deng)重点人(ren)(ren)群(qun)(qun)的职业道德建(jian)设(she)(she),利用(yong)单(dan)位(wei)、社区、学校、家庭(ting),加(jia)强(qiang)对失(shi)(shi)信(xin)(xin)个人(ren)(ren)的教(jiao)(jiao)育(yu)和(he)(he)(he)(he)(he)帮助。(县委宣传(chuan)部、县文明(ming)办、县电视(shi)台分别(bie)牵头,各(ge)部门按(an)职责分工负责)

(一)强化组(zu)织实施。各(ge)部门(men)要(yao)按照本《意见》要(yao)求,切实加强组(zu)织领(ling)导,明(ming)确责任(ren)分工,细化目(mu)标任(ren)务,确保(bao)将联(lian)合奖惩(cheng)各(ge)项工作落实到位。

(二)完善配(pei)套制(zhi)度。各部(bu)门(men)要加快制(zhi)定本部(bu)门(men)、本行业“红黑名单(dan)(dan)”发(fa)布、守(shou)信联(lian)合(he)激励(li)和(he)失信联(lian)合(he)惩戒(jie)(jie)等制(zhi)度措施,积极发(fa)起和(he)配(pei)合(he)其他单(dan)(dan)位做好(hao)守(shou)信联(lian)合(he)激励(li)和(he)失信联(lian)合(he)惩戒(jie)(jie)工作。

(三)加(jia)强指导协调。县(xian)信用办要加(jia)大指导力度,积极帮助各部(bu)门(men)协调建(jian)立(li)联合(he)奖(jiang)惩机制(zhi),各部(bu)门(men)要主动作(zuo)为,扎实推动本(ben)部(bu)门(men)、本(ben)行业守信联合(he)激励和失(shi)信联合(he)惩戒工作(zuo)。

(四)健全报送机(ji)制。各部门要按(an)照《关于建立(li)我(wo)市报送守信(xin)激励和失信(xin)惩戒典(dian)型案例工作机(ji)制的通(tong)知》(哈诚办发(fa)〔2017〕1号)要求,建立(li)常(chang)态化(hua)报送机(ji)制,负责(ze)组织(zhi)、筛选和认定本部门、本行业守信(xin)失信(xin)典(dian)型案例,实时或(huo)至(zhi)少每月20日(ri)前向县信(xin)用办报送,依(yi)法依(yi)规公开。

(五)加大考核(he)力度。将本《意见(jian)》明(ming)确(que)的工(gong)(gong)作(zuo)任(ren)(ren)务纳入(ru)年(nian)度县(xian)直机(ji)关专项(xiang)工(gong)(gong)作(zuo)责任(ren)(ren)目标(biao)、乡(xiang)镇经济(ji)社会发展主(zhu)要责任(ren)(ren)指标(biao)考核(he)范围。县(xian)信用办要加强对(dui)各乡(xiang)镇、各部(bu)门(men)的督(du)促(cu)检(jian)查,及时跟踪掌握(wo)各项(xiang)工(gong)(gong)作(zuo)进展情况(kuang),督(du)促(cu)检(jian)查任(ren)(ren)务落实情况(kuang)并及时报县(xian)政府。
