  伊春市建立完善守信联(lian)合激励和失信联(lian)合惩戒制度加快推进社会诚信建设(she)实施(shi)方案

  为贯彻落实《国务院关于建立(li)完(wan)善(shan)守(shou)信联合激励(li)和失(shi)信联合惩戒制度(du)加快(kuai)推(tui)进(jin)社会诚信建设(she)的指(zhi)导意见》(国发(fa)〔2016〕33号)和《黑龙江省人民政府关于建立完善守信联合激励和失信联合惩戒制度加快推进社会诚信建设的实施意见》(黑政规〔2017〕5号)精神,结合我市实际,制定本方案。

  一、总体要求

  (一(yi))指导思想(xiang)。全(quan)面(mian)贯(guan)彻党的十(shi)(shi)八大和(he)十(shi)(shi)八届三中(zhong)、四中(zhong)、五中(zhong)、六中(zhong)全(quan)会精神(shen),深(shen)入贯(guan)彻习(xi)近平(ping)总(zong)书记系列(lie)重要(yao)讲(jiang)话特别是对我省两次重要(yao)讲(jiang)话精神(shen),按照党中(zhong)央、国务院决策部署,紧紧围绕“四个全面”战略布局,牢固树立创新、协调、绿色、开放、共享发展理念,落实加强和创新社会治理要求,加快推进社会信用体系建设,加强信用信息公开和共享,依法依规运用信用激励和约束手段,构建政府、社会共同参与的跨地区、跨部门、跨领域的守信联合激励和失信联合惩戒机制,促进市场主体依法诚信经营,维护市场正常秩序,营造诚信社会环境。

  (二)工作目标。到2017年底,基本建立政府部门联合奖惩机制,推动企业、自然人、社团组织、机关事业单位信用信息的查询、公开共享和管理应用服务;建立完善信用分类管理、信用信息归集共享、信用信息公示、信用协同监管,使守信激励和失信惩戒机制在重要领域较好发挥作用。到2020年底,全面建成政府与社会共同参与的联合奖惩机制,形成政府部门协同联动、行业组织自律管理、信用服务机构积极参与、社会舆论广泛监督的共同治理格局。

  二、工作任务

  (一)健全褒扬和激(ji)励(li)诚信行为机制

1.探索建立行(xing)政(zheng)审批“绿(lv)色(se)通(tong)道”。在办理行(xing)政(zheng)许(xu)可过程中,对诚信典型和(he)连续三年无不(bu)良(liang)信用记录的(de)行(xing)政(zheng)相对人(ren),可根据(ju)实(shi)际(ji)情况实(shi)施“绿(lv)色(se)通(tong)道”和(he)“容缺(que)受理”等便(bian)利服务(wu)措施。对符合条件(jian)的(de)行(xing)政(zheng)相对人(ren),除法律法规要求提供(gong)的(de)材(cai)料(liao)外,部分申报材(cai)料(liao)不(bu)齐备(bei)的(de),如其书面(mian)承诺(nuo)在规定期限内提供(gong),应先行(xing)受理,加(jia)快办理进(jin)度。(责任单位:中、省、市直有关单位,各县〔市〕、区政(zheng)府)

2.优(you)先提供公共服务便利。在(zai)实施财政(zheng)性资(zi)金项目安排、招商(shang)引资(zi)配套(tao)优(you)惠政(zheng)策等各类政(zheng)府优(you)惠政(zheng)策中,优(you)先考虑(lv)诚信(xin)市(shi)(shi)(shi)(shi)场主体,加大扶持力(li)度。在(zai)教(jiao)育、就业(ye)、创业(ye)、医疗卫(wei)生、社会保障等领域对诚信(xin)个人给(ji)予重点支持和优(you)先便利。在(zai)有关公共资(zi)源(yuan)交易活动中,提倡依法依约(yue)对诚信(xin)市(shi)(shi)(shi)(shi)场主体采取(qu)信(xin)用(yong)加分等措(cuo)施。(责任单位(wei):市(shi)(shi)(shi)(shi)发改委、市(shi)(shi)(shi)(shi)财政(zheng)局(ju)〔国(guo)(guo)资(zi)办〕、市(shi)(shi)(shi)(shi)商(shang)务局(ju)、市(shi)(shi)(shi)(shi)教(jiao)育局(ju)、市(shi)(shi)(shi)(shi)人社局(ju)、市(shi)(shi)(shi)(shi)卫(wei)计委、市(shi)(shi)(shi)(shi)住(zhu)建局(ju)、市(shi)(shi)(shi)(shi)国(guo)(guo)土资(zi)源(yuan)局(ju)、市(shi)(shi)(shi)(shi)交通运输局(ju)、市(shi)(shi)(shi)(shi)水务局(ju)、市(shi)(shi)(shi)(shi)水文局(ju)、市(shi)(shi)(shi)(shi)工商(shang)局(ju),各县〔市(shi)(shi)(shi)(shi)〕、区(qu)政(zheng)府)

3.优(you)化(hua)诚信企(qi)业行政监(jian)(jian)管(guan)安排。各(ge)级市场(chang)监(jian)(jian)管(guan)部门应(ying)根据监(jian)(jian)管(guan)对象的(de)信用记(ji)录和信用评价分类,注重运(yun)用大数(shu)据手段,完善(shan)事(shi)中事(shi)后监(jian)(jian)管(guan)措施,为市场(chang)主体提供便利化(hua)服务。对符合一(yi)定条(tiao)件的(de)诚信企(qi)业,在(zai)日常检(jian)查(cha)、专项检(jian)查(cha)中优(you)化(hua)检(jian)查(cha)频次(ci)。(责(ze)任单位:中、省、市直有关(guan)单位,各(ge)县〔市〕、区(qu)政府(fu))

4.降低(di)市场(chang)(chang)交易(yi)(yi)成(cheng)本。鼓励(li)有关部门和(he)单位(wei)开发“税(shui)易(yi)(yi)贷”、“信(xin)(xin)易(yi)(yi)贷”、“信(xin)(xin)易(yi)(yi)债”等(deng)守(shou)信(xin)(xin)激励(li)产(chan)品。引导(dao)征信(xin)(xin)机(ji)构加强(qiang)对(dui)(dui)市场(chang)(chang)主(zhu)体(ti)(ti)正面信(xin)(xin)息(xi)的采集,对(dui)(dui)守(shou)信(xin)(xin)者加大激励(li)性评分(fen)比重。引导(dao)金融机(ji)构和(he)商业(ye)销(xiao)售机(ji)构等(deng)市场(chang)(chang)服(fu)务机(ji)构参(can)考(kao)使(shi)用市场(chang)(chang)主(zhu)体(ti)(ti)信(xin)(xin)用信(xin)(xin)息(xi)、信(xin)(xin)用积分(fen)和(he)信(xin)(xin)用评价结果,对(dui)(dui)诚信(xin)(xin)市场(chang)(chang)主(zhu)体(ti)(ti)给予优(you)惠(hui)和(he)便利,使(shi)守(shou)信(xin)(xin)者在(zai)市场(chang)(chang)中获得更多机(ji)会(hui)和(he)实惠(hui)。(责(ze)任单位(wei):市金融办、市地税(shui)局、市国(guo)税(shui)局、人民银行伊春(chun)(chun)市中心支(zhi)行、伊春(chun)(chun)银监分(fen)局,各县(xian)〔市〕、区政府(fu))

5.大力推介(jie)诚(cheng)(cheng)信(xin)(xin)典(dian)型(xing)(xing)。将有(you)关部(bu)门和(he)(he)(he)社(she)会(hui)(hui)(hui)(hui)(hui)(hui)组(zu)织实(shi)施(shi)信(xin)(xin)用(yong)(yong)(yong)分类监(jian)管确(que)定的(de)(de)信(xin)(xin)用(yong)(yong)(yong)状(zhuang)况良好的(de)(de)行政(zheng)相对人、诚(cheng)(cheng)信(xin)(xin)道德(de)模范、优(you)秀青年(nian)志愿(yuan)者(zhe),行业(ye)协会(hui)(hui)(hui)(hui)(hui)(hui)商(shang)会(hui)(hui)(hui)(hui)(hui)(hui)推荐(jian)的(de)(de)诚(cheng)(cheng)信(xin)(xin)会(hui)(hui)(hui)(hui)(hui)(hui)员,新闻媒体(ti)挖掘(jue)的(de)(de)诚(cheng)(cheng)信(xin)(xin)主体(ti)等树立为(wei)诚(cheng)(cheng)信(xin)(xin)典(dian)型(xing)(xing)。鼓励(li)有(you)关部(bu)门和(he)(he)(he)社(she)会(hui)(hui)(hui)(hui)(hui)(hui)组(zu)织在(zai)监(jian)管和(he)(he)(he)服务(wu)中建(jian)立各类主体(ti)信(xin)(xin)用(yong)(yong)(yong)记录,向社(she)会(hui)(hui)(hui)(hui)(hui)(hui)推介(jie)无不良信(xin)(xin)用(yong)(yong)(yong)记录者(zhe)和(he)(he)(he)有(you)关诚(cheng)(cheng)信(xin)(xin)典(dian)型(xing)(xing),联合其他(ta)部(bu)门和(he)(he)(he)社(she)会(hui)(hui)(hui)(hui)(hui)(hui)组(zu)织实(shi)施(shi)守信(xin)(xin)激(ji)励(li)。各级政(zheng)府部(bu)门应将诚(cheng)(cheng)信(xin)(xin)典(dian)型(xing)(xing)优(you)良信(xin)(xin)用(yong)(yong)(yong)信(xin)(xin)息及时在(zai)政(zheng)府网站和(he)(he)(he)“信(xin)(xin)用(yong)(yong)(yong)伊春”网站进行公示,在(zai)哈洽会(hui)(hui)(hui)(hui)(hui)(hui)、中俄博(bo)(bo)览(lan)会(hui)(hui)(hui)(hui)(hui)(hui)、绿色有(you)机(ji)食品博(bo)(bo)览(lan)会(hui)(hui)(hui)(hui)(hui)(hui)、森博(bo)(bo)会(hui)(hui)(hui)(hui)(hui)(hui)等会(hui)(hui)(hui)(hui)(hui)(hui)展活动以(yi)及银企对接等活动中重点推介(jie)诚(cheng)(cheng)信(xin)(xin)企业(ye),让信(xin)(xin)用(yong)(yong)(yong)成为(wei)市场配置(zhi)资源的(de)(de)重要(yao)考量因素。(责任(ren)单位:市委(wei)(wei)宣(xuan)传(chuan)部(bu)、市文明办、团市委(wei)(wei)、市工商(shang)局(ju)、市工信(xin)(xin)委(wei)(wei)、市金融办、市民政(zheng)局(ju)、市商(shang)务(wu)局(ju),各县〔市〕、区政(zheng)府)

  (二)健全约束和惩(cheng)戒(jie)失信行为机制

6.对(dui)重(zhong)点领(ling)域和(he)(he)(he)严(yan)(yan)(yan)重(zhong)失信(xin)行(xing)为(wei)实施联(lian)合(he)惩戒(jie)。在(zai)有(you)关部门和(he)(he)(he)社(she)(she)会(hui)(hui)(hui)组织依法(fa)依规对(dui)本领(ling)域失信(xin)行(xing)为(wei)作出(chu)处理和(he)(he)(he)评价(jia)基础上(shang),通过信(xin)息共享(xiang),推动其(qi)他部门和(he)(he)(he)社(she)(she)会(hui)(hui)(hui)组织依法(fa)依规对(dui)严(yan)(yan)(yan)重(zhong)失信(xin)行(xing)为(wei)采取联(lian)合(he)惩戒(jie)措施。重(zhong)点包括:一是(shi)严(yan)(yan)(yan)重(zhong)危害(hai)人(ren)民(min)(min)群众身体健(jian)康和(he)(he)(he)生(sheng)命安(an)(an)全(quan)(quan)(quan)的(de)(de)(de)行(xing)为(wei),包括食(shi)品药品、医疗卫生(sheng)、生(sheng)态(tai)环境、工程质(zhi)量、安(an)(an)全(quan)(quan)(quan)生(sheng)产、消(xiao)(xiao)防(fang)(fang)安(an)(an)全(quan)(quan)(quan)、强制(zhi)性产品认证、特种设备安(an)(an)全(quan)(quan)(quan)、进出(chu)境质(zhi)量安(an)(an)全(quan)(quan)(quan)和(he)(he)(he)卫生(sheng)安(an)(an)全(quan)(quan)(quan)等(deng)领(ling)域的(de)(de)(de)严(yan)(yan)(yan)重(zhong)失信(xin)行(xing)为(wei)。二是(shi)严(yan)(yan)(yan)重(zhong)破(po)坏(huai)市(shi)(shi)(shi)场公(gong)平竞(jing)争(zheng)秩序(xu)和(he)(he)(he)社(she)(she)会(hui)(hui)(hui)正常秩序(xu)的(de)(de)(de)行(xing)为(wei),包括贿赂、逃(tao)税骗税、恶意(yi)(yi)逃(tao)废债(zhai)务、恶意(yi)(yi)拖欠货款或(huo)服务费(fei)、未(wei)与(yu)劳(lao)动者(zhe)订(ding)立书面劳(lao)动合(he)同、不参加(jia)社(she)(she)会(hui)(hui)(hui)保(bao)险登记、未(wei)足额缴纳社(she)(she)会(hui)(hui)(hui)保(bao)险费(fei)、恶意(yi)(yi)欠薪、非法(fa)集(ji)资(zi)、合(he)同欺诈、传(chuan)(chuan)销、无证照经营、制(zhi)售(shou)假(jia)冒伪劣产品和(he)(he)(he)故意(yi)(yi)侵(qin)犯知识产权、出(chu)借和(he)(he)(he)借用资(zi)质(zhi)投(tou)标(biao)(biao)、围标(biao)(biao)串(chuan)标(biao)(biao)、以弄(nong)虚作假(jia)或(huo)行(xing)贿方式参与(yu)公(gong)共资(zi)源(yuan)(yuan)交易、泄漏(lou)应当(dang)保(bao)密的(de)(de)(de)与(yu)公(gong)共资(zi)源(yuan)(yuan)交易活动有(you)关的(de)(de)(de)情况和(he)(he)(he)资(zi)料、虚假(jia)广(guang)告(gao)、侵(qin)害(hai)消(xiao)(xiao)费(fei)者(zhe)或(huo)证券(quan)期货投(tou)资(zi)者(zhe)合(he)法(fa)权益、严(yan)(yan)(yan)重(zhong)破(po)坏(huai)网络空间传(chuan)(chuan)播(bo)秩序(xu)、聚众扰乱社(she)(she)会(hui)(hui)(hui)秩序(xu)等(deng)严(yan)(yan)(yan)重(zhong)失信(xin)行(xing)为(wei)。三是(shi)拒(ju)不履(lv)行(xing)法(fa)定义(yi)务,严(yan)(yan)(yan)重(zhong)影响司法(fa)机(ji)关、行(xing)政机(ji)关公(gong)信(xin)力的(de)(de)(de)行(xing)为(wei),包括当(dang)事人(ren)在(zai)司法(fa)机(ji)关、行(xing)政机(ji)关作出(chu)判决或(huo)决定后,有(you)履(lv)行(xing)能(neng)力但(dan)拒(ju)不履(lv)行(xing)、逃(tao)避(bi)(bi)执(zhi)行(xing)等(deng)严(yan)(yan)(yan)重(zhong)失信(xin)行(xing)为(wei)。四是(shi)拒(ju)不履(lv)行(xing)国防(fang)(fang)义(yi)务,拒(ju)绝(jue)、逃(tao)避(bi)(bi)兵役,拒(ju)绝(jue)、拖延(yan)民(min)(min)用资(zi)源(yuan)(yuan)征用或(huo)者(zhe)阻碍(ai)对(dui)被(bei)征用的(de)(de)(de)民(min)(min)用资(zi)源(yuan)(yuan)进行(xing)改造,危害(hai)国防(fang)(fang)利益,破(po)坏(huai)国防(fang)(fang)设施等(deng)行(xing)为(wei)。(责任(ren)单位:市(shi)(shi)(shi)工商局(ju)(ju)(ju)(ju)(ju)(ju)、市(shi)(shi)(shi)发改委、市(shi)(shi)(shi)财(cai)政局(ju)(ju)(ju)(ju)(ju)(ju)〔国资(zi)办(ban)(ban)〕、市(shi)(shi)(shi)环保(bao)局(ju)(ju)(ju)(ju)(ju)(ju)、市(shi)(shi)(shi)住(zhu)建局(ju)(ju)(ju)(ju)(ju)(ju)、市(shi)(shi)(shi)交通运输局(ju)(ju)(ju)(ju)(ju)(ju)、市(shi)(shi)(shi)公(gong)安(an)(an)局(ju)(ju)(ju)(ju)(ju)(ju)、市(shi)(shi)(shi)人(ren)社(she)(she)局(ju)(ju)(ju)(ju)(ju)(ju)、市(shi)(shi)(shi)水务局(ju)(ju)(ju)(ju)(ju)(ju)、市(shi)(shi)(shi)水文局(ju)(ju)(ju)(ju)(ju)(ju)、市(shi)(shi)(shi)食(shi)品药品监(jian)管(guan)局(ju)(ju)(ju)(ju)(ju)(ju)、市(shi)(shi)(shi)安(an)(an)监(jian)局(ju)(ju)(ju)(ju)(ju)(ju)、市(shi)(shi)(shi)质(zhi)监(jian)局(ju)(ju)(ju)(ju)(ju)(ju)、市(shi)(shi)(shi)地税局(ju)(ju)(ju)(ju)(ju)(ju)、市(shi)(shi)(shi)国税局(ju)(ju)(ju)(ju)(ju)(ju)、市(shi)(shi)(shi)科技(ji)局(ju)(ju)(ju)(ju)(ju)(ju)、市(shi)(shi)(shi)人(ren)防(fang)(fang)办(ban)(ban)、人(ren)民(min)(min)银行(xing)伊春市(shi)(shi)(shi)中(zhong)心支行(xing)、伊春出(chu)入境检(jian)验(yan)检(jian)疫局(ju)(ju)(ju)(ju)(ju)(ju)、市(shi)(shi)(shi)法(fa)院,各县〔市(shi)(shi)(shi)〕、区政府(fu))

7.依法(fa)依规(gui)加强(qiang)对(dui)失(shi)(shi)(shi)(shi)(shi)信(xin)行(xing)(xing)(xing)为(wei)(wei)(wei)的(de)(de)行(xing)(xing)(xing)政(zheng)(zheng)性约(yue)束和(he)惩(cheng)戒(jie)。对(dui)被(bei)(bei)列入(ru)经(jing)(jing)营(ying)异常名录、严重(zhong)违(wei)法(fa)失(shi)(shi)(shi)(shi)(shi)信(xin)企(qi)(qi)业(ye)、失(shi)(shi)(shi)(shi)(shi)信(xin)被(bei)(bei)执行(xing)(xing)(xing)人(ren)(ren)、重(zhong)大税(shui)收(shou)违(wei)法(fa)案件当事(shi)人(ren)(ren)、违(wei)法(fa)上市(shi)公(gong)(gong)(gong)司相关责(ze)任主(zhu)体(ti)、安(an)全(quan)生产(chan)(chan)领域失(shi)(shi)(shi)(shi)(shi)信(xin)生产(chan)(chan)经(jing)(jing)营(ying)单位及(ji)(ji)其(qi)有(you)关人(ren)(ren)员等(deng)(deng)严重(zhong)失(shi)(shi)(shi)(shi)(shi)信(xin)主(zhu)体(ti),各(ge)(ge)地(di)、各(ge)(ge)有(you)关部门应将(jiang)其(qi)列为(wei)(wei)(wei)重(zhong)点监(jian)(jian)管对(dui)象,依法(fa)依规(gui)采取(qu)行(xing)(xing)(xing)政(zheng)(zheng)性约(yue)束和(he)惩(cheng)戒(jie)措施。从(cong)严审(shen)核行(xing)(xing)(xing)政(zheng)(zheng)许可审(shen)批项目,从(cong)严控制(zhi)(zhi)生产(chan)(chan)许可证发(fa)(fa)放(fang),限制(zhi)(zhi)新增项目审(shen)批、核准,限制(zhi)(zhi)股(gu)票(piao)发(fa)(fa)行(xing)(xing)(xing)上市(shi)融(rong)资(zi)或发(fa)(fa)行(xing)(xing)(xing)债券,限制(zhi)(zhi)发(fa)(fa)起(qi)设(she)立或参股(gu)金(jin)(jin)(jin)融(rong)机(ji)构以及(ji)(ji)小额贷款(kuan)公(gong)(gong)(gong)司、融(rong)资(zi)担保公(gong)(gong)(gong)司、创业(ye)投资(zi)公(gong)(gong)(gong)司、互联(lian)网融(rong)资(zi)平台(tai)等(deng)(deng)机(ji)构,限制(zhi)(zhi)从(cong)事(shi)互联(lian)网信(xin)息服务等(deng)(deng)。严格限制(zhi)(zhi)申(shen)请财政(zheng)(zheng)性资(zi)金(jin)(jin)(jin)项目,限制(zhi)(zhi)参与有(you)关公(gong)(gong)(gong)共资(zi)源(yuan)交易(yi)活动(dong),限制(zhi)(zhi)参与基础设(she)施和(he)公(gong)(gong)(gong)用(yong)事(shi)业(ye)特许经(jing)(jing)营(ying)。对(dui)事(shi)权在(zai)(zai)国(guo)(guo)家(jia)和(he)省相关部门的(de)(de)惩(cheng)戒(jie)事(shi)项,在(zai)(zai)向国(guo)(guo)家(jia)和(he)省申(shen)报时,注明失(shi)(shi)(shi)(shi)(shi)信(xin)情况(kuang),建议国(guo)(guo)家(jia)和(he)省审(shen)慎对(dui)待(dai)。对(dui)严重(zhong)失(shi)(shi)(shi)(shi)(shi)信(xin)企(qi)(qi)业(ye)及(ji)(ji)其(qi)法(fa)定(ding)代表(biao)人(ren)(ren)、主(zhu)要负责(ze)人(ren)(ren)和(he)对(dui)失(shi)(shi)(shi)(shi)(shi)信(xin)行(xing)(xing)(xing)为(wei)(wei)(wei)负有(you)直(zhi)接责(ze)任的(de)(de)注册执业(ye)人(ren)(ren)员等(deng)(deng)实施市(shi)场和(he)行(xing)(xing)(xing)业(ye)禁入(ru)措施。被(bei)(bei)列入(ru)严重(zhong)违(wei)法(fa)失(shi)(shi)(shi)(shi)(shi)信(xin)企(qi)(qi)业(ye)名单的(de)(de)企(qi)(qi)业(ye)的(de)(de)法(fa)定(ding)代表(biao)人(ren)(ren)、负责(ze)人(ren)(ren),3年(nian)内不得担任其(qi)他企(qi)(qi)业(ye)的(de)(de)法(fa)定(ding)代表(biao)人(ren)(ren)、负责(ze)人(ren)(ren)。及(ji)(ji)时撤销严重(zhong)失(shi)(shi)(shi)(shi)(shi)信(xin)企(qi)(qi)业(ye)及(ji)(ji)其(qi)法(fa)定(ding)代表(biao)人(ren)(ren)、负责(ze)人(ren)(ren)、高级(ji)管理(li)人(ren)(ren)员和(he)对(dui)失(shi)(shi)(shi)(shi)(shi)信(xin)行(xing)(xing)(xing)为(wei)(wei)(wei)负有(you)直(zhi)接责(ze)任的(de)(de)董(dong)事(shi)、股(gu)东等(deng)(deng)人(ren)(ren)员的(de)(de)荣(rong)誉称(cheng)号(hao),取(qu)消参加评(ping)(ping)先评(ping)(ping)优资(zi)格。(责(ze)任单位:市(shi)工(gong)商局(ju)(ju)、市(shi)法(fa)院、市(shi)地(di)税(shui)局(ju)(ju)、市(shi)国(guo)(guo)税(shui)局(ju)(ju)、市(shi)安(an)监(jian)(jian)局(ju)(ju)、市(shi)发(fa)(fa)改(gai)委、市(shi)工(gong)信(xin)委、市(shi)金(jin)(jin)(jin)融(rong)办、市(shi)财政(zheng)(zheng)局(ju)(ju)、市(shi)质监(jian)(jian)局(ju)(ju),各(ge)(ge)县〔市(shi)〕、区政(zheng)(zheng)府(fu))

8.加强对(dui)(dui)(dui)失(shi)信(xin)(xin)(xin)行(xing)(xing)(xing)(xing)为(wei)的(de)市(shi)(shi)(shi)场性约束和惩戒。对(dui)(dui)(dui)严重(zhong)失(shi)信(xin)(xin)(xin)主体,有关(guan)部(bu)门和机构应以统一社会信(xin)(xin)(xin)用代(dai)码为(wei)索(suo)引,及时公(gong)开(kai)披露(lu)相关(guan)信(xin)(xin)(xin)息,便于市(shi)(shi)(shi)场识别失(shi)信(xin)(xin)(xin)行(xing)(xing)(xing)(xing)为(wei),防范(fan)信(xin)(xin)(xin)用风险。督促有关(guan)企业和个人履(lv)行(xing)(xing)(xing)(xing)法定义务,对(dui)(dui)(dui)有履(lv)行(xing)(xing)(xing)(xing)能力但拒不履(lv)行(xing)(xing)(xing)(xing)的(de)严重(zhong)失(shi)信(xin)(xin)(xin)主体实施限(xian)制(zhi)出境和限(xian)制(zhi)购买不动产(chan)、乘坐飞机、乘坐高(gao)等级列车(che)和席(xi)次、旅(lv)游度(du)假、入(ru)住星级以上宾馆及其他(ta)高(gao)消费行(xing)(xing)(xing)(xing)为(wei)等措(cuo)施。支持征(zheng)信(xin)(xin)(xin)机构采集严重(zhong)失(shi)信(xin)(xin)(xin)行(xing)(xing)(xing)(xing)为(wei)信(xin)(xin)(xin)息,纳入(ru)信(xin)(xin)(xin)用记(ji)录和信(xin)(xin)(xin)用报告。引导(dao)商(shang)业银行(xing)(xing)(xing)(xing)、证券期货(huo)经营机构、保险公(gong)司等金融机构按照风险定价原则,对(dui)(dui)(dui)严重(zhong)失(shi)信(xin)(xin)(xin)主体提高(gao)贷款利率和财产(chan)保险费率,或者限(xian)制(zhi)向其提供贷款、保荐、承(cheng)销、保险等服务。(责(ze)任单(dan)位:市(shi)(shi)(shi)法院、市(shi)(shi)(shi)公(gong)安局(ju)、市(shi)(shi)(shi)住建(jian)局(ju)、伊(yi)春林都机场、伊(yi)春铁路车(che)站、市(shi)(shi)(shi)旅(lv)发委(wei)、人民银行(xing)(xing)(xing)(xing)伊(yi)春市(shi)(shi)(shi)中(zhong)心(xin)支行(xing)(xing)(xing)(xing)、伊(yi)春银监分局(ju),各县〔市(shi)(shi)(shi)〕、区政(zheng)府)

9.加强对(dui)失(shi)信(xin)(xin)(xin)(xin)行(xing)(xing)为(wei)(wei)的行(xing)(xing)业(ye)(ye)性约(yue)(yue)束(shu)和惩戒。建立健全行(xing)(xing)业(ye)(ye)自律公(gong)约(yue)(yue)和职(zhi)业(ye)(ye)道德准(zhun)则(ze),推(tui)动行(xing)(xing)业(ye)(ye)信(xin)(xin)(xin)(xin)用(yong)建设(she)。引(yin)导行(xing)(xing)业(ye)(ye)协(xie)(xie)会(hui)商会(hui)完(wan)善行(xing)(xing)业(ye)(ye)内部信(xin)(xin)(xin)(xin)用(yong)信(xin)(xin)(xin)(xin)息采(cai)集、共享(xiang)机制,将严重失(shi)信(xin)(xin)(xin)(xin)行(xing)(xing)为(wei)(wei)记(ji)入会(hui)员(yuan)信(xin)(xin)(xin)(xin)用(yong)档案。鼓(gu)励(li)行(xing)(xing)业(ye)(ye)协(xie)(xie)会(hui)商会(hui)与(yu)有(you)资质的第(di)三方信(xin)(xin)(xin)(xin)用(yong)服务机构合作(zuo),开(kai)展会(hui)员(yuan)企业(ye)(ye)信(xin)(xin)(xin)(xin)用(yong)等(deng)级评价。支(zhi)持行(xing)(xing)业(ye)(ye)协(xie)(xie)会(hui)商会(hui)按照行(xing)(xing)业(ye)(ye)标准(zhun)、行(xing)(xing)规、行(xing)(xing)约(yue)(yue)等(deng),视情节轻重对(dui)失(shi)信(xin)(xin)(xin)(xin)会(hui)员(yuan)实(shi)行(xing)(xing)警告(gao)、行(xing)(xing)业(ye)(ye)内通报批评、公(gong)开(kai)谴责、不予接纳、劝退等(deng)惩戒措施(shi)。(责任单(dan)位:中、省、市直有(you)关(guan)单(dan)位,各县〔市〕、区(qu)政府(fu))

10.加(jia)强对(dui)(dui)失(shi)(shi)信行(xing)为(wei)(wei)的(de)社(she)会性(xing)约束和惩戒。引导社(she)会力量广(guang)泛(fan)参与(yu)失(shi)(shi)信联合惩戒。建立(li)完善失(shi)(shi)信举(ju)报(bao)(bao)(bao)制度,鼓励公(gong)众(zhong)举(ju)报(bao)(bao)(bao)企业严重失(shi)(shi)信行(xing)为(wei)(wei),对(dui)(dui)举(ju)报(bao)(bao)(bao)人信息严格(ge)保密。鼓励公(gong)正、独(du)立(li)、有条件(jian)的(de)社(she)会机构开(kai)展失(shi)(shi)信行(xing)为(wei)(wei)大数(shu)据舆情监测(ce),编制发布地区、行(xing)业信用分析报(bao)(bao)(bao)告。充(chong)分发挥各(ge)类社(she)会组织作(zuo)用,支持有关社(she)会组织依法(fa)(fa)对(dui)(dui)污染(ran)环境、侵害消费者(zhe)或公(gong)众(zhong)投资者(zhe)合法(fa)(fa)权益等群体性(xing)侵权行(xing)为(wei)(wei)提(ti)起公(gong)益诉讼(song)。(责任单位(wei):市(shi)(shi)工商局、市(shi)(shi)民(min)政(zheng)局、市(shi)(shi)环保局、市(shi)(shi)公(gong)安(an)局,各(ge)县〔市(shi)(shi)〕、区政(zheng)府(fu))

11.完善个人(ren)(ren)信用(yong)记(ji)(ji)录,推动(dong)联(lian)合(he)(he)(he)惩(cheng)戒(jie)措(cuo)施(shi)落实到人(ren)(ren)。对(dui)企事(shi)(shi)(shi)业单(dan)(dan)位(wei)(wei)严重失(shi)(shi)(shi)信行为,在记(ji)(ji)入企事(shi)(shi)(shi)业单(dan)(dan)位(wei)(wei)信用(yong)记(ji)(ji)录的同(tong)时(shi),记(ji)(ji)入其法定代表人(ren)(ren)、主要负责人(ren)(ren)和其他负有直接责任(ren)人(ren)(ren)员(yuan)的个人(ren)(ren)信用(yong)记(ji)(ji)录。在对(dui)失(shi)(shi)(shi)信企事(shi)(shi)(shi)业单(dan)(dan)位(wei)(wei)进行联(lian)合(he)(he)(he)惩(cheng)戒(jie)的同(tong)时(shi),依照法律(lv)法规(gui)和政策规(gui)定对(dui)相关责任(ren)人(ren)(ren)员(yuan)采取相应的联(lian)合(he)(he)(he)惩(cheng)戒(jie)措(cuo)施(shi)。通过建(jian)立完整的个人(ren)(ren)信用(yong)记(ji)(ji)录数(shu)据库(ku)及联(lian)合(he)(he)(he)惩(cheng)戒(jie)机制,使失(shi)(shi)(shi)信惩(cheng)戒(jie)措(cuo)施(shi)落实到人(ren)(ren)。(责任(ren)单(dan)(dan)位(wei)(wei):市(shi)编委办、市(shi)人(ren)(ren)社局、市(shi)工(gong)商局、市(shi)公(gong)安局,各县(xian)〔市(shi)〕、区政府)

15.建(jian)立健全(quan)信(xin)(xin)用(yong)修(xiu)复机制(zhi)。联合(he)惩(cheng)戒(jie)措施的(de)发(fa)起部(bu)门(men)(men)和实施部(bu)门(men)(men)应按照法律(lv)法规(gui)(gui)和政(zheng)策规(gui)(gui)定(ding)明确各类(lei)失(shi)信(xin)(xin)行为(wei)的(de)联合(he)惩(cheng)戒(jie)期(qi)限。在规(gui)(gui)定(ding)期(qi)限内(nei)纠(jiu)正失(shi)信(xin)(xin)行为(wei)、消除(chu)不良影响的(de),不再(zai)作为(wei)联合(he)惩(cheng)戒(jie)对(dui)象。建(jian)立有(you)利于(yu)自(zi)我(wo)纠(jiu)错、主动自(zi)新的(de)社会鼓励与关爱机制(zhi),支持有(you)失(shi)信(xin)(xin)行为(wei)的(de)个人通(tong)过社会公益服务等方式(shi)修(xiu)复个人信(xin)(xin)用(yong)。(责任单位(wei):中、省、市直有(you)关单位(wei))

16.建立健全(quan)信(xin)(xin)用(yong)主(zhu)体(ti)权(quan)(quan)益保护机(ji)制。建立健全(quan)信(xin)(xin)用(yong)信(xin)(xin)息异议(yi)、投诉制度。有关(guan)部(bu)门和单(dan)位在执行失信(xin)(xin)联(lian)合(he)(he)(he)惩(cheng)戒措施(shi)时主(zhu)动发现、经市场主(zhu)体(ti)提(ti)出异议(yi)申请或投诉发现信(xin)(xin)息不(bu)(bu)实的,应(ying)及时告知信(xin)(xin)息提(ti)供(gong)单(dan)位核(he)实,信(xin)(xin)息提(ti)供(gong)单(dan)位应(ying)尽快(kuai)核(he)实并反馈。联(lian)合(he)(he)(he)惩(cheng)戒措施(shi)在信(xin)(xin)息核(he)实期(qi)间暂不(bu)(bu)执行。经核(he)实有误的信(xin)(xin)息应(ying)及时更(geng)正或撤销。因错误采取联(lian)合(he)(he)(he)惩(cheng)戒措施(shi)损害有关(guan)主(zhu)体(ti)合(he)(he)(he)法权(quan)(quan)益的,有关(guan)部(bu)门和单(dan)位应(ying)积(ji)极采取措施(shi)恢复其(qi)信(xin)(xin)誉(yu)、消除不(bu)(bu)良(liang)影响。支(zhi)持有关(guan)主(zhu)体(ti)通过行政复议(yi)、行政诉讼等方式维护自身合(he)(he)(he)法权(quan)(quan)益。(责任单(dan)位:中、省(sheng)、市直有关(guan)单(dan)位)

  (二)加(jia)强跟踪问效。充分利(li)用省信用信息共享交(jiao)换平(ping)台和(he)“信用伊春”网站,建立健全信用联合激励惩戒的跟踪、监测、统计、评估机制并建立相应的督查、考核制度,将考核结果纳入对各地、各部门年度责任目标考核。对信用信息归集、共享和激励惩戒措施落实不力的部门和单位,进行通报和督促整改,切实把各项联合激励和联合惩戒措施落到实处。市工商局要加强统筹协调,及时跟踪掌握工作进展,督促检查任务落实情况并报告市政府。市政府将对本方案的贯彻落实情况适时开展专项督查。(责任单位:市政府办、市工商局,各县〔市〕、区政府)
